Washington State Prenuptial Agreement
This Prenuptial Agreement (the "Agreement") is made and entered into this ____ day of ____________, 20__, (the "Effective Date") by and between ____________________ (the "First Party") and ____________________ (the "Second Party"), who, by entering into this Agreement, intend to establish the respective rights and responsibilities of each party concerning each other's property and financial obligations should their upcoming marriage dissolve or in the event of either party's death.
WHEREAS, the parties contemplate legal marriage under the laws of the State of Washington, and it is their mutual desire to establish their respective rights and duties regarding each other’s property and financial responsibilities both during the marriage and afterward.
NOW, THEREFORE, in consideration of the impending marriage, and in consideration of the mutual promises and covenants contained herein, the parties agree as follows:
Article 1: Disclosure of Assets and Liabilities
Each party has fully and fairly disclosed to the other party their respective financial situations, including all assets and liabilities. Attached hereto as Exhibit A (for the First Party) and Exhibit B (for the Second Party) are complete financial statements reflecting each party's financial situation as of the date hereof.
Article 2: Property Rights
A. Separate Property: Any property acquired by either party prior to the marriage or by gift, bequest, devise, or descent during the marriage, and the income or appreciation of such property, shall remain the sole and separate property of the acquiring party.
B. Marital Property: All property acquired by the parties during the marriage which does not qualify as Separate Property under Washington law shall be considered marital property and shall be subject to distribution upon dissolution of the marriage as provided by this Agreement or by Washington law.
Article 3: Spousal Support
Each party retains the right to seek spousal support in the event of a dissolution of marriage, but any such spousal support shall be determined in accordance with the terms of this Agreement and not by reference to any statutory formula or presumption under Washington law.
Article 4: Amendment and Revocation
This Agreement may only be amended or revoked by a written document signed by both parties and acknowledged with the same formality as this Agreement.
Article 5: Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without giving effect to any choice of law or conflict of law provisions.
Article 6: Execution and Acknowledgment
IN WITNESS WHEREOF, the parties have executed this Agreement as of the Effective Date first above written.
